NALCO’s proposed dacion en pago denied
The proposal of Nasipit Lumber Company, Inc. (NALCO) to settle its long overdue tax in the amount of PhP 1,383,668.25 to the City Government of Butuan by way of dacion en pago of its alleged property located in Barangay Tungao was denied by the 12th Sangguniang Panlungsod in its adoption of Resolution No. 401-2011 on May 16, 2011, A RESOLUTION DENYING THE DACION EN PAGO PROPOSAL OF NALCO, AND FOR OTHER PURPOSES.
The decision was based on the findings of the Committee on Human Settlements that NALCO was not issued a title of the subject 25,912 square-meter lot. NALCO applied for titling thereof, but this was cancelled by the Department of Environment and Natural Resources (DENR) Caraga on November 4, 2008.
NALCO appealed the decision to the Office of the DENR Secretary. But this is being countered by the Sanggunian, through its adoption of the related policy, Resolution No. 402-2011, “A RESOLUTION INTERPOSING OBJECTION TO THE APPEAL OF NASIPIT LUMBER (NALCO) BEFORE THE OFFICE OF THE DENR SECRETARY, AND FOR OTHER PURPOSES.”
