Eligibility conferred through elected office

 

            Since its enactment, the Local Government Code of 1991 provides for the civil service eligibility of barangay officials.  In Paragraph 2 (b) of Section 393 (Benefits of Barangay Officials) thereof, it is stated that “the punong barangay, the sangguniang barangay members, the barangay secretary shall be entitled to appropriate civil service eligibility on the basis of the number of years to the barangay, pursuant to the rules and regulations of the Civil Service Commission.” 

            Despite the fact that higher-ranking officials from the sanggunian in the municipal, city, and provincial levels fulfill bigger responsibilities, they do not enjoy this privilege provided by the law.  Thus, to address this inequity, two bills were filed at the Philippine Senate.  The first is Senate Bill No. 2735, AN ACT CONFERRING CAREER SERVICE PROFESSIONAL ELIGIBILITY UPON REGULAR AND EX-OFFICIO MEMBERS OF THE SANGGUNIANG BAYAN, SANGGUNIANG PANLUNGSOD AND SANGGUNIANG PANLALAWIGAN, AND FOR OTHER PURPOSES, introduced by Senator Jinggoy Estrada, and filed on March 9, 2011.  The second is Senate Bill No. 2736, AN ACT PROVIDING ADDITIONAL INCENTIVES TO THE MEMBERS OF THE SANGGUNIANG BAYAN, THE SANGGUNIANG PANLUNGSOD, AND THE SANGGUNIANG PANLALAWIGAN BY CONFERRING TO THEM THE APPROPRIATE CIVIL SERVICE ELIGIBILITY, introduced by Senator Teofisto Guingona III, and filed on March 11, 2011. 

            The 12th Sangguniang Panlungsod supports the passage of these bills into laws.  And so in its 22nd Regular Session on May 30, 2011, it passed SP Resolution No.  415-2011, A RESOLUTION EARNESTLY REQUESTING THE SENATE THRU THE COMMITTEE ON CIVIL SERVICE AND PROFESSIONAL REGULATION TO FAST-TRACK THE PASSAGE OF SENATE BILL NOS. 2735 AND 2736, BOTH CONFERRING AN APPROPRIATE CIVIL SERVICE ELIGIBILITY UPON A MEMBER OF THE SANGGUNIANG BAYAN, SANGGUNIANG PANLUNGSOD, AND SANGGUNIANG PANLALAWIGAN WHO HAS SERVED THREE (3) CONSECUTIVE TERMS OF OFFICE. 

            The Sanggunian members hope that with the passage of these bills into laws, they will now have the opportunity to be conferred with the appropriate civil service eligibility, to reinforce the dignity of their offices as elected public servants, and to serve as a fitting reward for their dedication to promote the public welfare.
